Terms of Service

Please read these Terms of Service ("Terms") carefully before using Fourdesk ("the Service", "we", "us"). By creating an account or using Fourdesk in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Fourdesk is an AI-powered trading analysis and journaling platform. It provides tools for chart analysis, trade logging, psychological check-ins, performance coaching, and risk management reminders. The Service is provided for educational and organizational purposes only and does not constitute financial advice of any kind.

2. Eligibility

You must be at least 18 years old to use the Service. By using Fourdesk, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

3. Account Registration

You must create an account to access most features. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@fourdesk.io if you become aware of any unauthorized use of your account.

4. Subscriptions and Payments

Fourdesk offers a Free tier and a Pro subscription. Pro subscriptions are billed monthly at the rate displayed at the time of purchase.

  • Subscriptions renew automatically unless canceled before the renewal date.
  • You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued.
  • We reserve the right to change pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.
  • Payments are processed by third-party payment providers. We do not store your payment card details.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable regulations.
  • Attempt to reverse-engineer, scrape, or extract data from the Service.
  • Upload content that is false, misleading, defamatory, or that infringes the rights of any third party.
  • Use the Service to provide financial advice to others or to operate a regulated financial service.
  • Interfere with the security, integrity, or availability of the Service.

6. Intellectual Property

All software, design, text, and content forming part of the Service are owned by Fourdesk or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial purposes.

Content you upload (charts, journal entries, notes) remains yours. You grant Fourdesk a limited license to process that content solely for the purpose of providing the Service to you.

7. No Financial Advice

Nothing produced by the Service — including chart analysis, risk alerts, coaching summaries, or psychological insights — constitutes financial advice, investment advice, or a recommendation to buy or sell any financial instrument. Trading carries a significant risk of loss. Always conduct your own research and consult a qualified financial advisor before making investment decisions.

8. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, Fourdesk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, goodwill, or other intangible losses, resulting from your use of the Service.

Our total aggregate liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid to Fourdesk in the twelve months preceding the claim.

9. Termination

You may stop using the Service at any time and delete your account from account settings. We may suspend or terminate your access if we believe you have violated these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice at least 14 days before they take effect. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Las Palmas de Gran Canaria, Canary Islands, Spain, without prejudice to your rights as a consumer under applicable EU law.
